Work description

Ofwat’s consultation which closed on 30 November 2015 described how Ofwat would exercise its statutory powers and duties in relation to Interim Supply. Following on from the consultation exercise, we will need to develop a ‘draft’ Interim Supply Code in early 2016 that reflects the outcome of the consultation. We plan to consult on the proposed text of this legal instrument during February 2016. In addition to the ‘draft’ code, the consultation document will also need to contain a summary of the responses and outline our policy decisions and the rationale for them. Pending the outcome of the consultation on the code, further drafting amendments may be required. A final code would be issued before the end of March 2016.

The successful candidate will be responsible for leading the development of the draft and final interim supply code as set-out in this document.

Key responsibilities within the programme

The successful candidate will work closely with Ofwat staff within Retail Market Opening work-stream.

The successful candidate will be required to develop drafting for the interim supply code and present (or develop proposals to present) at internal Ofwat and industry meetings and the Ofwat Board. This work will involve:

• Drafting the interim supply code, including liaising with internal Ofwat legal staff; • Drafting the consultation document for the interim supply code, including a summary of responses and our policy decisions and rationale; • Drafting the final code and associated decision documentation.

Key Outputs

a) Draft Interim Supply Code by the end of January 2016

b) Draft Consultation Document by end of January 2016

c) Final Interim Supply Code by mid March 2016

Skills and Experience

The Customer expects that the Contractor’s Staff nominated for the Services will have the following skills and experience:

Broad regulatory knowledge and experience

An understanding of:

• Ofwat’s statutory duties and strategic policy goals • The water and sewerage sector in England and Wales • The opening of regulated markets to competition from a regulatory, economic and customer protection perspective

Specific knowledge, skills and experience:

• Detailed knowledge of Retail Market Opening in the water sector in England • A good understanding of supplier of the last resort arrangements in the utility sector • A good knowledge of the proposed Exit Regulations for the English water sector • An understanding of statutory codes and their purpose; • Experience of taking code proposals through their governance processes. • Experience running workshops successfully.
